PRIVACY STATEMENT FOR DELTA DESIGNS LTD.

Delta Designs Ltd. explains in this privacystatement where your personal data is collected and for what purpose. Delta Designs Ltd. would like to point out your risks, rights and obligations in terms of handling your personal data. Delta Designs Ltd. would also like to explain in which way you can exercise your rights when it comes to your personal data.

2. DATA PROCESSING
Through services of Delta Designs Ltd. and / or third parties, privacy sensitive data is being processed. Under processing we define the following: using your personal data, like the adding of data, saving the data, forwarding the data or the deletion of your data. Delta Designs Ltd. uses the data among others, to ensure a correct and full experience of our services. Delta Designs Ltd. uses your personal data the ensure correct delivery of your orders, to complete our agreements with you, management information, product and service development, to conduct analyses and to adhere to (local) legal obligations.

3. TYPES OF DATA THAT WE STORE

  • Name, address, city;
  • Contact data like (mobile) phone number and email address;
  • Date of birth and age;
  • Location data;
  • Login data;
  • Payment data like billing address, bank account number and credit card data;
  • Data linked to your employer, function and income data;
  • Detailed (technical) data in order to use our services, websites and apps. We collect information regarding: type of device and properties, type of browser and language, date and type of interaction and IP-address;
  • Data regarding your talents or interest divided into categories.Important to note is that Delta Designs Ltd. will not use all data collected from everyone. The type of data that is being used is dependent upon the types of service you use and the purpose of the data that is being processed by Delta Designs Ltd.

Delta Designs Ltd. does not process any personal data such as, ethnic background, race, political standpoints, religion, union membership, sexual orientation or legal (criminal) data.
Delta Designs Ltd. only processes personal data supplied by our customers. Personal data is also handed over when signing up for our newsletter.
Only with your explicit consent will your mail address be add to our send list. Our customers have the options to unsubscribe via a link that is included in every email we send.
Delta Designs Ltd. does not process any personal data for other purposes then the original intended purpose before asking your specific consent to do so and only after receiving your consent.

4. SOURCE OF DATA ACQUISITION
Delta Designs Ltd. will request data from it’s customers and customers are free to provide or withhold this data. To use certain services it is necessary for the customer to provide certain data, a customer is always free to withhold this data with the understanding that, that service can not be used. There is also data that Delta Designs Ltd. obtains automatically, think about detailed data about devices used by the customer. Delta Designs Ltd. obtains this data via cookies and comparable technology.

5. PURPOSE OF THE DATA PROCESSING
Delta Designs Ltd. uses your data for the following purposes:

  • To be able to offer you the services and products of Delta Designs Ltd. and to make sure they function correctly;
  • Execution of the agreement;
  • Execution of the analysis;
  • Compliance with legal obligations.

6. CONSENT
Delta Designs Ltd. will only process the personal data in accordance with the General Data Protection Regulation (GDPR). If the processing of personal data is based on an explicit consent, you always have the right to withdraw the consent.

7. DATA PROCESSING NECESSARY FOR EXECUTION OF THE AGREEMENT
In some cases Delta Designs Ltd. processes your data because this is necessary for the execution of the agreement. Without this processing, Delta Designs Ltd. can not deliver the services / products. You should think of the following information, e-mail address, first name, last name, newsletters preferences, name and address details of your employer.

8. DATA PROCESSING REQUIRED BY COMPLIANCE WITH LEGAL OBLIGATIONS
Delta Designs Ltd. can process data because it is legally required. Under the law, Delta Designs Ltd. must, for example, keep payment data for at least 7 years for the Tax Authorities.

Delta Designs Ltd. will not keep the personal data longer than necessary. The period during which the personal data will be stored, for administrative and financial data (including personal data), is 10 years from the moment of registration and for other data 5 years from the moment of registration and more years depending on the duration of the agreement and the agreed warranty period.

9. DATA PROCESSING FOR LEGITIMATE INTEREST
Delta Designs Ltd. can also process data if there is a legitimate interest for Delta Designs Ltd. itself or a third party. This concerns, for example, company interests. In such a case Delta Designs Ltd. will always make a thorough weighing of interests with your privacy as the most important starting point. Delta Designs Ltd. will use this basis as an exception and try to use the aforementioned principles under 6, 7 or 8 earlier if possible.

10. RECIPIENTS OF PERSONAL DATA
Your data can be exchanged and combined within Delta Designs Ltd. and Delta Designs Ltd. affiliated companies.

For the processing of personal data, Delta Designs Ltd. uses third parties that sometimes get access to your data. Delta Designs Ltd. makes agreements with these processors for the instructions and security standards that they must use. This is legally agreed upon in a so-called processor agreement. 

All personal data is collected and stored in software made available by a supplier from Canada. This supplier does not have access to this data itself unless explicit access has been granted by Delta Designs Ltd. , this fact is legally agreed upon in a processor agreement.

Delta Designs Ltd. will not pass on data from EU customers to countries outside the EU, unless Delta Designs Ltd. is obliged to do so by law or court order. 

For our Swiss customers, the data is collected at our head office in Panningen, The Netherlands. This data can be used by employees who belong to the EU.

11. COOKIES
We use cookies on this and other websites of Delta Designs Ltd. Delta Designs Ltd. uses the following cookies:

  • Analytical cookies: for analyzing and collecting statistics to improve the experience on the website and advertisements.
  • Functional cookies: for the workability of the website
  • Social cookies: to provide the opportunity to share, for example, comments or articles.

    By using our services and the website, you agree that we place and read cookies on our websites. Your consent remains valid for the duration of the agreement and until you withdraw it.

12. PROFILING
We can use profiling for our services. This includes the following: analyzing, collecting and combining personal data with the aim of dividing you into a specific category.
By means of profiling Delta Designs Ltd. can derive, related interests, content you may be interested in and which products and services would suit you.

Profiling can have an impact on your privacy. This could be due to inaccurate or incorrect and outdated data, so that wrong categories are linked to you. If the foregoing is the case, you can contact Privacy@bruynzeel.org. Delta Designs Ltd. will then take measures, for example, resetting or removing your profile.

13. COMPLAINT
The General Data Protection Regulation gives you the right to submit a complaint to the (Dutch) Data Protection Authority.

14. SECURITY PERSONAL DATA
Delta Designs Ltd. respects the rights and obligations arising from the General Data Protection Regulation. Delta Designs Ltd. does its utmost to protect your personal data as well as possible and takes appropriate technical and organizational measures which, in view of current technological advances, try to prevent someone from gaining unauthorized access to the data, so that data is kept secret.

If Delta Designs Ltd. works with (sub-) processors, Delta Designs Ltd. requires them to work with your data according to the same security standards.

15. RIGHTS FOR YOU AS A DATA SUBJECT
You may request insight of your personal data. You can also request us to improve your personal data, supplement, remove or screen if these are incorrect, incomplete or irrelevant, or otherwise processed in violation of a legal requirement. You can also object to the processing of the personal data and request that the personal data be transferred.

You can request us, at any time, to exercise one of the aforementioned rights. Send an email with your request to: Privacy@bruynzeel.org, Mention in your e-mail as clearly as possible what personal data your request is for and which right you wish to use. Delta Designs Ltd. tries to respond within a period of 4 weeks.

16. CHANGES
Delta Designs Ltd. reserves the right to unilaterally amend or change this privacy statement at any time and for any reason whatsoever.
